Sub Contractor Requirements
All Sub Contractors working for MDS must comply with the following minimum standards and conditions:
1. |
They will act in accordance with the Laws of the local State or Territory. |
2. |
They will perform their work in accordance with the relevant International Standard, or if none exists, to the Generally Accepted Industry code. |
3. |
Perform their work in a safe manner and keep records of their work. |
4. |
Maintain a Public Liability Policy for all their activities of at least $10 million provide a certificate of currency for the period of the work. |
5. |
Maintain a Workers Compensation Policy and provide a certificate of currency for the period of the work. |
6. |
Maintain Comprehensive Motor Vehicle Insurance for any Vehicles used on the contract. |
7. |
Provide a Subcontractors Statement with every Invoice. |
8. |
Maintain their Plant and Equipment in accordance with the Manufacturers recommendations and keep wriitten maintenance records which may be inspected by MDS if requested. |
9. |
Operate in a Safe manner that will minimise risk to Personnel and the Environement |
10. |
Maintain all employment records in an organised manner which may be inspected by MDS if requested. |
11. |
Pay employees to at least the minimum standard required by the relevant Award or site agreement and in compliance with the Australian Government's National Code of Practice for the Construction Industry 1997 (the Code) . |
12. |
Only employ staff as employees and pay all SGC superannuation payments. |
MDS agrees: |

To act fairly and honestly with sub-contractors |
2. |
To pay all valid invoices no later than 30 days from the End of the Month. |
MDS Reserves the Right to: |

Withhold payment if the Sub-Contractor has not provided the Subcontractor's Statement with their Invoices. |
2. |
Withhold payment if the Sub-Contractor has not paid its Statutory requirements to its employees. |
Where a dispute occurs between MDS and its Sub-contractor, MDS will make every effort to negotiate the issue in a conciliatory manner. If no resolution can be found we agree to be bound by the findings of an Independent Arbitrator. |
